For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ARBORIST. A position requiring training and expertise in the field of arboriculture.
CURBING. An elevated portion of the street improvement primarily constructed to direct surface storm water to a collection point and located at the outer boundaries of the paved surface of the street.
DIRECTOR. The Village of South Elgin Director of Public Works or his or her designee.
IMPROVEMENT. Any significant work that modifies the existing conditions of the public right-of-way as determined by the Director.
ISA. The International Society of Arboriculture.
PARKWAY. A portion of the right-of-way between the outer boundary of the paved surface of the street or curbing and the lot or parcel adjacent to the right-of-way. The PARKWAY may include sidewalk, driveways, vehicle parking, trees, shrubs, seeded and/or sodded lawn areas and utility services.
PAVEMENT STRUCTURE. The combination of base, and surface course materials placed on a subgrade to support the traffic volume and weight for distribution to the road bed.
PRIVATE PLANTINGS. Flowers, ornamental grasses and other ornamental non-woody vegetation planted by private homeowners in the village right-of-way.
PROPERTY OWNER. The record owner or contract purchaser of any parcel of land.
PUBLIC WAY. A street, alley, or other parcel of land open to the outside air and leading to a public street. A PUBLIC WAY is deeded or otherwise permanently appropriated for public use.
RIGHT-OF-WAY (R.O.W.). A strip of land occupied or intended to be occupied by a street, sidewalk and/or railroad, and by electrical transmission lines, oil or gas pipelines, water mains, sanitary or storm sewer mains, trees, vehicle parking, driveways, and/or for other special uses. The usage of the term RIGHT-OF-WAY for land-platting purposes shall mean that every right-of-way hereafter established and shown on a final plat is to be separate and distinct from the adjoining lots or parcels. RIGHTS-OF-WAY intended for streets, crosswalks, water mains, sanitary sewers, storm drains, trees, or any other use involving maintenance by a public agency shall be dedicated to public use by recording the plat on which such right-of-way is established.
ROOT FLARE. The exposed roots that flare out above grade from the base of a tree.
SHRUBBERY. A group of low, usually several stemmed woody plants.
SIDEWALK. That portion of the parkway consisting of a hard surface and primarily used bv pedestrians for walking.
SIDEWALK, APPROACH TYPE. A parkway structure intended for pedestrian use usually extending from the curbing or edge of the pavement to the edge of the right-of-way. This APPROACH SIDEWALK is intended primarily for the private convenience of the adjacent lot or parcel.
SMALL ORNAMENTAL TREE. The following trees qualify as SMALL ORNAMENTAL TREES: Serviceberry, Eastern Redbud, Japanese Tree Lilac, Amur Maple, Susan Magnolia, Japanese Red Maple, Hawthorn, Pagoda Dogwood, Flowering Crabapple, and other similar species that the Director, exercising his or her sole discretion, determines to be appropriate.
TREE. A woody perennial plant having main stem or trunk exceeding ten feet in height at maturity.
UTILITY. The privately, publicly or cooperatively owned lines, facilities and systems for producing, transmitting or distributing communications, power, electricity, light, heat, gas, oil, crude products, water stream, waste, storm water not connected with the highway drainage, and other similar commodities, including combined antenna television cables and equipment, and publicly owned fire and police signal systems and street lighting systems, which directly or indirectly serve the public or any part thereof. The term UTILITY as the context shall require, shall also mean the utility company, inclusive of any wholly owned or controlled subsidiary.
VOLCANO MULCHING. Mulch that has been piled up around and in contact with the trunk of the tree, similar in appearance to the shape of a volcano.
