§ 38.02 DISHONORED CHECKS OR DRAFTS.
   (A)   For the purposes of this section, the term UNPAID OR DISHONORED CHECK OR DRAFT shall mean any check or other negotiable instrument which is received by the village, deposited by the village into one or more of its accounts or which is otherwise endorsed and negotiated by the village and which check is returned unpaid to the village for any reason including, but not limited to, the fact that the account of the drawer or maker has been closed, there are insufficient funds in the account of the maker or drawer or a stop payment order has been requested by the drawer or maker. The term UNPAID OR DISHONORED CHECK OR DRAFT shall also include any other check or negotiable instrument received by the village, negotiated or deposited by the village and which is dishonored and for which funds are not received by the village.
   (B)   In the event any person, company, business or other entity delivers, tenders or otherwise gives to the village any check or draft or other negotiable instrument which is determined by the village to be an unpaid or dishonored check or draft, the drawer or maker, as listed on the check or draft or other negotiable instrument, shall pay to the village a fee in the amount of $30 per check, plus any applicable bank service charge, payable immediately to the village on oral or written notice to the drawer or maker. The payment of said fee shall, in no event, release the maker or drawer of the check or draft or other negotiable instrument from any and all other and further liability and, to the contrary, the village shall have the right to exercise any and all other rights and remedies notwithstanding the payment of the $30 fee. All payments provided for in this section including both said $30 fee and such unpaid or dishonored checks or drafts shall be made either in cash or by bank drafts, cashier checks or certified checks but not by personal checks.
   (C)   It shall be a violation of this section for any person, company, business or other entity to deliver, tender or otherwise give to this village any check or draft or other negotiable instrument which is determined by the village to be an unpaid or dishonored check or draft.
