§ 157.035 VARIANCE AND EXCEPTIONS.
   (A)   The Planning Commission may, upon application to it and showing of undue hardship, grant variance and exceptions to any of the provisions of this chapter, providing the variance or exception is in harmony with the general purpose and intent of this chapter.
   (B)   The Planning Commission may request and consider the opinion of the Soil and Water Conservation District and the Planning Engineer before deciding upon any variance or exception.
   (C)   In any event the conditions and criteria for granting an appeal or variance request regarding property within the identified floodplain or floodway shall be as outlined in 44 C.F.R. Chapter 1, § 60.6 (10-1-1986 edition).
