§ 31.17 POWERS; GENERALLY.
   (A)   The Board of Zoning Appeals shall have the following powers:
      (1)   To hear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by an administrative official in the enforcement;
      (2)   To authorize, upon appeal, in specific cases, such variance from the terms of the subchapter as will not be contrary to the public interest, where owning to special conditions, a literal enforcement of the subchapter will result in unnecessary hardship, and so that the spirit of the subchapter shall be observed and substantial justice done; and
      (3)   To grant conditional zoning certificates for the use of the land, buildings, or other structures for specific uses as provided for in the subchapter.
   (B)   In exercising the above-mentioned powers, such Board may, in conformity with such section, reverse or affirm, wholly or partly, or modify the order, requirement, decision, or determination appealed from and may make such order, requirement, decision or determination as ought to be made, and to that end shall have all powers of the officer from whom the appeal is taken.
