§ 93.05 PERMITS REQUIRED.
   (A)   No person shall hereafter prune, trim, plant, replant, remove or dispose of any street trees in or on the tree lawn, in or on the public right-of-way, or in or on property owned by the village, unless that person shall have first obtained a permit in writing from the Tree Commission as hereinafter set forth.
   (B)   The Tree Commission shall have the authority to deny a permit to any person who proposes to prune, trim, plant, replant, remove or dispose of any street tree in or on the tree lawn, in or on the public right-of-way, or in or on property owned by the village if the location is found by the Tree Commission to be of a size or type unsuitable for the permit purposes.
   (C)   The Tree Commission shall have the authority to deny a permit to any person who proposes to prune, trim, plant, replant, remove or dispose of any street tree in or on the tree lawn, in or on the public right-of-way, or in or on property owned by the village, when in the sole discretion of the Tree Commission it determines that such a permit is not in the best interest of the village.
   (D)   Every permit issued by the Tree Commission shall:
      (1)   Be in writing and shall describe the purpose of the permit, and shall contain a date of issuance;
      (2)   Specify the location for which the permit is issued;
      (3)   Specify the species, variety, size and/or nursery grade of the street tree involved;
      (4)   Briefly describe or specify the method of accomplishing the purpose of the permit;
      (5)   Contain a definite expiration date; and
      (6)   Contain the statement: “Any violation of the terms of this permit shall result in the immediate revocation of this permit. You may receive a citation for such violation which could result in your being fined or imprisoned.”
   (E)   The Tree Commission shall meet at the designated quarterly meeting and the Tree Commission shall approve, disapprove or table any permit application then pending. If a permit application is tabled, the Tree Commission shall notify the applicant immediately of further investigation.
