(a) Every person displaying, selling or engaging in the business of selling Christmas trees in the City shall obtain a permit from the City Treasurer and shall pay a fee of one dollar ($1.00).
(b) In addition to the fee of one dollar ($1.00), the applicant shall deposit with the City Treasurer the sum of twenty dollars ($20.00) in cash, to guarantee that all trees, branches and debris remaining on the premises after the Christmas season is over shall be removed and the premises left clean and free thereof. The provisions of this section shall not be applicable to nurseries or places of business displaying, selling or engaging in the business of selling only live evergreens or live Christmas trees, the roots of which are suitably encased in burlap or other material.
If all trees, branches and debris shall have been removed and the premises left free and clear thereof, on or before January 10th of the succeeding year, the twenty dollar ($20.00) deposit shall be returned by the City Treasurer to the permittee. If these conditions are not complied with by January 10th of the succeeding year, the twenty dollar ($20.00) deposit shall be retained by the City as indemnification for the cost of removing trees, branches and debris.
