349.20 VEHICLE SECURITY; INSURANCE.
   (a)   Whoever operates a motor vehicle within the City shall be responsible to see that such vehicle carries a valid motor vehicle liability policy. No person shall operate a motor vehicle which does not have such coverage nor operate a motor vehicle when the operator thereof is not a listed insured on the motor vehicle's liability policy.
   (b)   The certificate of insurance provided for in West Virginia Code 17D-2A-4 or other proof of insurance, shall be carried by the operator in the appropriate vehicle for use as proof of security; provided, that an operator shall not be guilty of a violation of this subsection if he furnishes proof to the Municipal Court that such insurance was in effect at the time of being cited for not carrying such certificate or other proof in such vehicle. As used in this section, proof of insurance means a certificate of insurance, an insurance policy or a mechanically reproduced copy of an insurance policy.
