712.12 MANDATORY SAFETY EQUIPMENT.
   (a)   On and after April 1, 2023, it shall be unlawful for any Person to operate, to Let, or to Rent to another for occupancy any Dwelling in the City unless the following requirements are met:
            (1)    The maximum occupancy certificate that sets forth occupancy limits of the Dwelling and each Dwelling Unit that is rented separately is posted in a common area within the Dwelling: Provided, That the Owner or Operator may specify and post lower occupancy limits.
            (2)    The dwelling contains operational smoke alarms in all common areas, bedrooms, and Dwelling Units. Battery-powered smoke alarms shall be permitted where the Owner or Operator has demonstrated that the testing, maintenance, and battery replacement procedures will ensure reliable power to the smoke alarms.
            (3)    The dwelling contains operational carbon monoxide alarms in all common areas, bedrooms, and Dwelling Units if there is any equipment present in the Dwelling that may generate carbon monoxide, including but not limited to gas stoves, gas water heaters, or gas furnaces, wood stoves, or fireplaces. Battery-powered carbon monoxide alarms shall be permitted where the Owner or Operator has demonstrated that the testing, maintenance, and battery replacement procedures will ensure reliable power to the carbon monoxide alarms.
            (4)    The applicable business license and Residential Rental License, as well as emergency contact information for the Owner or Operator, law enforcement, and fire department is posted in a common area within the Dwelling. (Ord. 2335. Passed 1-19-23.)
