1717.01 PREREQUISITES FOR ISSUANCE OF MOVING PERMIT.
   No permit for the moving of a building shall be issued until the contractor, owner or mover complies with the following provisions:
   (a)   The contractor, owner or mover shall pay a fee to the City Treasurer of twenty-five dollars ($25.00) for the issuance of such permit.
   (b)   The contractor, owner or mover shall sign an agreement furnished by the City, which agreement shall provide for the following:
      (1)   A detailed report stating the location of the building and the site to which removal is to be made and the proposed route for moving;
      (2)   Maintenance of watchmen and placing of safeguards by the contractor, owner or mover around such building during the entire time the same is located within or upon public streets in the City in such manner as to protect the residents of the City, pedestrians and motor or other traffic using the streets from injury by reason of moving the building;
      (3)   Liability on the part of the contractor, owner or mover for injury to any and all property including streets, sidewalks, trees and shrubs resulting from the moving of the building;
      (4)   Employment of competent electricians by the contractor, owner, or mover, to remove and replace all traffic lights belonging to the City located on the streets of which the building is to be moved; and
      (5)   Employment by the contractor, owner or mover of competent, skillful and careful workmen and the moving of the building as expeditiously and as speedily as possible and the completion of the moving of the building within one day.
   (c)   The contractor, owner or mover shall furnish the City with a good surety bond issued by a surety bonding company authorized to do business in the State, in the amount of ten thousand dollars ($10,000), conditioned to indemnify, protect and save harmless the City from all damages to persons or property arising out of or caused by the moving of the building in question and for the faithful performance of the conditions of the permit.
   (d)   A permit for the moving of buildings shall be of no force or effect whatsoever until the permittee shall have assented to the same by affixing his signature and shall have filed the requisite surety bond, properly executed with the City.
   (e)   In the event the contractor, owner or mover fails to comply with subsection (b)(4) hereof, the City shall employ competent electicians to have the street lights belonging to the City removed and replaced, and shall charge such contractor, owner or mover for the costs thereof for which he and the surety on his bond shall be liable.
