1709.01 ADOPTION.
   There is hereby adopted and attached hereto and made a part hereof for the purpose of safeguarding life and property and to ensure the quality construction of all structures erected, renovated, or removed throughout the City that certain code known as the State Building Code as filed by the State Fire Commission pursuant to West Virginia Code 15A-11-5 as a Legislative Rule, Title 87, Series 4, with an effective date of August 1, 2022, and authorized by the West Virginia Legislature, as it shall be amended from time to time. The City also hereby adopts the following codes as incorporated by reference as if set forth herein:
   (a)    International Building Code, 2018 edition, with exceptions as noted in 87 CSR 4.4.1.a.;
   (b)    The International Plumbing Code, 2018 edition;
   (c)    The International Mechanical Code, 2018 edition, with additions as noted in 7 CSR 4.4.1.c.;
   (d)    The International Fuel Gas Code, 2018 edition, with the exception as noted in 87 CSR 4.4.1.d.;
   (e)    The International Property Maintenance Code, 2018 edition;
   (f)    The International Energy Conservation Code for residential buildings, 2015 edition, with the exception as noted in 87 CSR 4.4.1.f.;
   (g)    The ANSI/ASHRAE/IESNA Standard 90.1 for commercial buildings, 2013 edition;
   (h)    The International Residential Code for One- and Two-Family Dwellings, 2018 edition, with exceptions as noted in 87 CSR 4.4.1.h. through 4.4.1.k.;
   (i)    The ICC/ANSI A117.1 American National Standards for Accessible & Usable Buildings & Facilities, 2017 edition;
      (j)    The International Existing Building Code, 2018 edition;
    (k)    The National Electrical Code, NFPA 70, 2020 edition, with exceptions as noted at 87 CSR 4.4.1.m.; and
      (l)    The International Swimming Pool and Spa Code, 2018 edition.
   Wherever referenced in the several ICC codes adopted above, any reference to the International Fire Code should be substituted with the NFPA Life Safety Code, 2021 edition. One copy of each such code incorporated in the State Building Code, certified by the Mayor, shall be maintained on file in the office of the City Clerk and shall be available to the public for inspection during regular business hours.
