(a) There is hereby adopted by the City, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion that certain code known as the National Fire Protection Association Code, as it shall be amended from time to time, and current regulations adopted by the State Fire Commission, except such portions as are deleted, modified or amended by this article, and the same are hereby adopted and incorporated as fully as if set out at length herein from the date on which this section takes effect.
(b) The provisions of the Code shall be controlling within the City, except in I-4 Heavy Industrial Districts and I-2 Light Industrial Districts, as defined in the Zoning Ordinance. Although this Code shall not be applicable except as hereinafter provided in I-4 and I-2 Districts, for the purpose of ascertaining and causing to be corrected any condition liable to cause fire or endanger life from fire or explosion, the owners and occupants of premises, buildings and facilities in I-4 and I-2 Districts shall make available to the Fire Prevention Bureau for inspection and review their inspection reports, records and other documents pertaining to their premises, buildings and facilities made by their officers or employees or made by representatives of their insurance companies if the owner or occupant of premises, buildings or facilities located in I-4 and I-2 Districts fails to make adequate inspections, fails to make and keep adequate inspection reports, fails or refuses to make inspection reports, fails or refuses to make inspection reports available to the Bureau or fails or refuses to remedy any dangerous or hazardous condition reported and found to exist, after twenty days' written notice from the Bureau specifying the noncompliance or inadequacies, this Code shall in all respects become applicable to that or those persons, premises, buildings and facilities. The person so notified shall be entitled to a hearing before the Bureau if requested, within twenty days after receipt of such notice and shall, within twenty days, be entitled to an appeal from a final decision of the Bureau to Council.
(c) The Chief of the Bureau of Fire Prevention or his inspectors may issue a citation for violations of the National Fire Protection Association Code, or for other violations of this article. Violations for which a citation may be issued include, but are not limited to:
(1) Failing to correct NFPA Code items as directed by the Chief of the Bureau of Fire Prevention.
(2) Failing to provide inspection reports, records or other documents as required by the Chief of the Bureau of Fire Prevention.
(3) Tampering with, or rendering inoperable, on-premises firefighting equipment, fire detection equipment or fire alarm systems.
(4) Illegally parking in a fire lane.
Each and every day during which any illegal use or refusal to provide information continues after official notice has been given in writing, shall be deemed a separate offense and subject to being re-cited for the offense. (Ord. 1939. Passed 2-5-98.)
