1339.06 REAR YARD EXCEPTIONS.
   (a)   Reductions.
      (1)   For each foot by which a lot, at the time of the enactment of this Zoning Ordinance, is less than 100 feet deep, four inches may be deducted from the required least depth of the rear yard; provided, that no required rear yard shall be less than ten feet deep in any case.
      (2)   In any residential district where a lot runs through a block from street to street, an open space equivalent to the required rear yard may be provided upon such a lot in lieu of a required rear yard.
   (b)   Structures or Projections.
      (1)   No permitted projection into a required rear yard shall extend within ten feet of the centerline of an alley or of a rear lot line, if no alley exists, or within three feet of an accessory building.
      (2)   A wall, planting or fence, any of which are not over six feet high above the average natural grade, in all residential districts and over eight feet high above the average natural grade in all commercial and industrial districts, may be erected within the limits of a rear yard. Such wall, planting or fence may be higher than six feet in residential districts and eight feet in commercial and industrial districts if a retaining wall or, if above such height, at least seventy-five percent (75%) of its surface is unobstructed and open in a uniformly distributed manner. A barbed wire fence of two feet maximum height may be erected above a wall or fence of six feet or greater height in any commercial or industrial district.
   The provisions of subsection (b)(2) hereof are, however, subject to the health and safety requirements of the City and, as such, the power to reject the allowances of subsection (b)(2) hereof is hereby reserved to the City.
      (3)   Bay windows or balconies, occupying in the aggregate not more than one- half of the width of the rear wall of the building, may project not more than three feet into a required rear yard.
      (4)   A fire escape or fire tower may project into a required rear yard.
      (5)   Chimneys or flues, elevator shafts, belt courses, leaders, sills, pilasters, lintels, ornamental features, cornices, eaves, gutters, etc., may project into a required rear yard.
      (6)   Garages and other accessory buildings or structures shall in no instance be less than three feet from the lot line.
