1339.04 FRONT YARD EXCEPTIONS.
   (a)   Existing Alignment in Residential Districts. In any residential district, where the average depth of existing front yards of the nearest existing buildings located within 100 feet on each side of a lot and within the same block front as in such lot is greater than is prescribed in this Zoning Ordinance, the depth of the front yard on such lot shall be not less than the average depth of such existing front yard; or, if there is only one such building within 100 feet, the depth shall not be less than the average of the depth of the front yard of such building and the depth specified in this ordinance for the district in which such lot is located; nor shall the depth be less nor need it be greater, in the case of a corner lot, than that of the existing front yard on the lot immediately adjoining; provided, that the depth shall be not less than ten feet; and provided further, that no building shall extend into the public right of way.
   Where, by action of public authority, a street has been relocated so as to create exceptionally deep lots and exceptionally deep front yards and where fifty percent (50%) or more of the frontage within any block front is developed with buildings, the required front yard for a building which is to be erected or altered on any lot shall not be less nor need it be greater, than the average of the depth of front yards of the nearest existing buildings on each side; or, if there are buildings on only one side, the depth shall be the same as that of the nearest existing building.
   (b)   Structures or Projections. The front yard requirements of this ordinance shall not apply in any zoning district to:
      (1)   Front fences, planting or walls any of which are not over four feet high above the average natural grade; terraces, steps, uncovered porches or other similar features not over three feet high above the level of the floor of the ground story and distant five feet from every lot line.
   The provisions of subsection (b)(1) hereof are, however, subject to the health and safety requirements of the City and, as such, the power to reject the allowances of subsection (b)(1) hereof is hereby reserved to the City.
      (2)   Bay windows, eaves or balconies occupying in the aggregate not more than one-third of the front wall of the building if extending not more than three feet into a required front yard.
      (3)   Chimneys, flues, belt courses, leaders, sills, pilasters, lintels, ornamental features, cornices gutters, etc.
