1339.03 EXCEPTIONS TO YARD REQUIREMENTS GENERALLY.
   The minimum yard requirements contained in the previous ordinance of 1948, as revised in 1962, will remain in effect for a period of eighteen months after the passage of this Zoning Ordinance, as determined by the Planning Commission; provided, that:
   (a)   Unnecessary hardship is borne by the property owner as the result of the passage of this ordinance.
   (b)   The home or business structure, i.e. building only, of the property owner was in conformance with the previous ordinance and made nonconforming by this ordinance; and that reconstruction is necessary due to a fault other than that of the property owner; negligence shall not be considered a fault.
   (c)   In no instance, unless otherwise provided by the Planning Commission, shall construction or reconstruction be granted in situations such as those described above where the required yards are less than as provided by the previous ordinance.
