The following rules of construction shall apply to the text of this Zoning Ordinance:
(a) The particular shall control the general.
(b) In case of any difference of meaning or implication between the text of this ordinance and any caption, illustration, summary table or illustrative table, the text of this ordinance shall control.
(c) "Shall" shall be interpreted as mandatory and not discretionary; "may" as permissive.
(d) Words used in the present tense include the future; words used in the singular number include the plural and the plural the singular, unless the context clearly indicates the contrary.
(e) "Building" or "structure" includes any part thereof.
(f) "Used for" includes "arranged for," "designed for," "intended for," "maintained for" or "occupied for."
(g) "Person" includes an individual, a corporation, a partnership, and incorporated association or any other similar entity.
(h) Unless the context clearly indicates the contrary, where a regulation involves two or more items, conditions, provisions or events connected by the conjunction "and," or "either...or," the conjunction shall be interpreted as follows:
(1) "And" shall indicate that all the connected items, conditions, provisions or events apply.
(2) "Or" shall indicate that the connected items, conditions, provisions or events may apply singly or in any combination.
(3) "Either...or" shall indicate that the connected items, conditions, provisions or events apply singly but not in combination.
(i) "Includes" shall not limit a term to the specified examples, but shall extend its meaning to all other instances or circumstances of similar character.
(j) All terms defined under various sections of the City Building Code, where occurring in this ordinance, shall have the meanings specified in the Building Code, except where specifically defined in this ordinance.
(k) All terms defined under various sections of the City Subdivision Regulations, as set forth in Chapter Seven, where occurring in this ordinance shall have the meanings specified in Chapter Seven except where specifically defined in this ordinance.
(l) "State" means the State of West Virginia. "County" means the County of Kanawha, State of West Virginia. "City" means the City of South Charleston, State of West Virginia; and "city boundary" means any exterior boundary of the City.
(m) "City Council," "Mayor," "Municipal Planning Commission," "Board of Zoning Appeals," "City Solicitor," "City Engineer," "Building Inspector," "Fire Chief," "Park and Recreation Director," "County Board of Education," "Sanitary Board" and "City-County Health Director" means the respective Council, boards and officers of the City and County.
(n) "R district" means any residential district, the first letter of the symbol for which is the letter "R." "C district" means any commercial district, the first letter of the symbol for which is the letter "C." "I district" means any industrial district, the first letter of the symbol for which is the letter "I."
