1119.04 ORDER TO ABATE.
   When the Property Board or any member thereof finds that a nuisance exists on any premises, vacant lot or building, a notice, either written or oral (if oral, to be followed immediately by a written notice), shall be served upon the owner or his agent, the occupant or the tenant thereof ordering the nuisance to be abated or removed either by filling, draining, cleaning, purifying, destroying or removing the same as the case may be. No owner, occupant, tenant or agent so served shall fail, within the given time indicated in the notice, to comply with such order, or fail to show cause to the Property Board or any member thereof why he cannot or ought not comply with such order; provided, that any person so served shall be entitled to be heard before the Property Board. The aforementioned time period to abate the nuisance shall be determined on a case by case basis, depending upon the seriousness of the particular offense.
