(a) Definitions. The following words or terms when used herein shall be deemed to have the meanings set forth below:
(1) “Building materials” shall include, without limitation, lumber, bricks, concrete, or cinder blocks, plumbing materials, electric wiring or equipment, heating ducts or equipment, shingles, mortar, cement nails, screws, or any other materials used in constructing any structure. “Building materials” does not include those materials or equipment related to projects for which a current, valid building permit has been issued.
(2) “Junk” shall include, without limitation, parts of machinery or motor vehicles, unused furniture, stoves, refrigerators, or other appliances, remnants of wood, metal, or any other castoff matter of any kind, whether or not the same could be put to any reasonable use.
(3) “Person” shall include all natural persons, firms, co-partnerships, corporations, and all associations of natural persons, incorporated or unincorporated, whether acting by themselves or by a servant, agent, or employee. All persons who violate any of the provisions of this article, whether as owner, occupant, lessee, agent, servant or employee shall, except as herein otherwise provided, be equally liable as principals.
(4) “Premises” shall enclose any porch, deck, balcony, roof, patio, yard, or curtilage of any residential building or structure, other than in a completely enclosed building or structure.
(5) “Rubbish” shall include any and all forms of debris not otherwise classified.
(b) Except as hereinafter provided, no person shall cause or permit the accumulation of refuse, building materials, junk, or rubbish in, about, or upon premises owned, occupied or used by him, when and if, in the judgment of the Property Board, Chief of Public Works, or Fire Chief, such accumulation is unsightly, unsanitary, or hazardous to the property, life, health, safety, or welfare of the public.
(c) Exclusions. The provisions of this section shall not apply to the storage or placement upon any property of the following materials:
(1) Firewood intended for consumption in a wood-burning stove, furnace, indoor fireplace, or outdoor patio fireplace located within or outside a building located upon the subject premises, provided that all such firewood shall, at all times, be stacked and stored in an appropriate place, but in no event upon the front porch of any house or other residential structure.
(2) Lawn, yard, garden, or playground tools, ornaments, equipment, or implements.
(3) Lawn or patio furniture.
(4) Standing fences.
(5) Hoses or sprinklers used for watering lawns or gardens.
(6) Construction materials and equipment used for the construction, renovation, or razing of a building located upon the premises for which a current building or razing permit has been issued.
(d) Enforcement. Such accumulations of refuse, building materials, junk, or rubbish in violation of this section shall be treated as a public nuisance and handled in accordance with Article 1119 of the Health and Sanitation Code.
