955.06 TYPES OF REFUSE NOT COLLECTED BY CITY; REFUSAL OF SERVICE.
   (a)   Except as otherwise provided, the City shall not collect, remove or dispose of the following types of refuse:
      (1)   Offal.
      (2)   Sewage.
      (3)   Animal excreta.
      (4)   Carcasses of animals.
      (5)   Batteries that must be recycled or disposed of properly, that cause a substantial risk of fire or explosion if placed together with other garbage, refuse, or trash, or that constitute a substantial environmental risk, including but not limited to lead-acid batteries and lithium-ion batteries.
      (6)   Material resulting from the demolition, repair, alteration, or erection of buildings or structures by a contractor or from a commercial building or structure.
      (7)   Tires.
      (8)   Covered electronic devices as defined in West Virginia Code Section 22-15A-2 (including televisions, computers, and video display devices).
      (9)   Any items prohibited from being placed in a landfill by state or federal law, rule, or regulation or prohibited from being collected by the City pursuant to City Code.
   No person shall set out for collection any garbage, refuse, or trash that is prohibited from being collected, removed or disposed of pursuant to this section.
   (b)   The City shall have the right to deny refuse service to any person whose refuse requirements are sufficiently abnormal or different, in the opinion of the Chief of Public Works, as to justify special handling; in which case a special charge shall be made. This shall include those buildings or dwellings not readily accessible to refuse collectors or where refuse is not found in standard containers.
