(a) The Mayor with the advice of the City Attorney and the City Engineer is hereby authorized to enter into a form agreement with those who wish to use a public right of way for a private purpose.
(b) Public right of way shall not be interpreted so as to include air rights, and no air rights shall be granted under the authority of this section.
(c) Public right of way shall not be interpreted so as to allow encroachment of a building structure upon a public right of way, and no such encroachment shall be granted under the authority of this section.
(d) The decision of whether to grant the private use of a public right of way shall be in the discretion of the Mayor.
(e) If such permission is denied by the Mayor, the individual so denied may appeal to Council within ten days of such denial.
