§ 152.40  SETBACK DISTANCES.
   (A)   Findings incorporated. The findings set forth above are incorporated into the body of this section as if fully set forth herein.
   (B)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      PROHIBIT THE LOCATION OR CONSTRUCTION OF HOUSES, BUILDINGS, MANUFACTURED HOMES, MOBILE HOMES, AND OTHER STRUCTURES. Unless in compliance with the setback distances as set forth herein. That prior to providing any city service, the City Inspector shall verify that setback distances have been complied with as herein set forth.
      SETBACK. The established distance that a house, building, manufactured home, mobile home or other structure must be from adjacent property line, alleys or street right-of-way.
   (C)   Enforcement. Prior to the location or construction of any house, building, manufactured home, mobile home and other structure and the subsequent connection of any public utility or other city service, a City Inspector shall examine and inspect the property of the requesting party to verify that the proper setback distance is obtainable and that the requesting party by locating or constructing the house, building, manufactured home, mobile home and other structure in compliance with the setback distances as established by city ordinance and that the compliance shall again be verified prior to the initial connection or reconnection of a public utility or city service.
   (D)   Effective date. This section shall be effective upon its passage and publication as required by law.
