§ 152.04  PERMIT FOR MANUFACTURED HOME LOCATION.
   (A)   It shall be unlawful for any person to locate a manufactured home within the limits of the city unless that person holds a valid permit issued by the city in the name of that the person for the location of a manufactured home, or the specific construction, alteration or extension proposed.
   (B)   Upon application, the installation of HUD-code manufactured homes shall be permitted as residential dwelling in those areas determined appropriately by the city, including subdivisions, planned unit developments, single lots and rental communities and parks. An application to install a HUD-code manufactured home for use and occupancy as a residential dwelling is deemed approved and granted unless the city denies the application in writing within 45 days from receipt of the application setting forth the reason.
   (C)   This section shall not affect the validity of any deed restriction that is otherwise valid.
   (D)   All applications for permits shall be made upon standard forms provided by the city and shall contain and/or be accompanied by the following:
      (1)   Name and address of the applicant;
      (2)   Location, dimensions and legal description of the manufactured home, lot, stand or site;
      (3)   Make, model, serial number and dimensions of the manufactured home;
      (4)   A site plan sketch showing setbacks and open space distances, adjourning streets and locations of manufactured home; and
      (5)   Payment of a permit.
   (E)   When upon review of the application, the City Manger or his or her designee is satisfied that the proposed plan meets the requirements of this chapter, a permit shall be approved and a permit shall be issued.
   (F)   Any person whose application for a permit under this chapter has been denied, may request a hearing on the matter under the procedure provided by § 152.06.
   (G)   A non-refundable fee of $125 per manufactured home placement within a mobile home park or on a manufactured home lot.
