§ 93.02  OUTDOOR BURNING.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CITY.  The City of Sour Lake.
      EXTINGUISH.  means the absence of any visible flames, glowing coals or smoke.
      OUTDOOR BURNING.  Any burning regulated by Title 30, §§ 111.201 - 111.221 of the Texas Administrative Code.
      PRESCRIBED BURN.  The controlled application of fire to naturally occurring vegetative fuels under specified environmental conditions and confined to a predetermined area, following appropriate planning and precautionary measures.
      SUNRISE/SUNSET.  Official sunrise/sunset as set forth in the United States Naval Observatory table’s available from the National Weather Service office.
      TCEQ.  Texas Commission on Environmental Quality.
   (B)   Outdoor burning in residential area within the city. Outdoor burning may be done on private property in residentially zoned area under the following conditions:
      (1)   The burning must be a “prescribed burn” as defined in this section.
      (2)   The burning must be on-site burning of brush, grass, leaves, branch trimmings, or other plant growth by the owner of the property or other per authorized by the owner, and the material is generated only from that property.
      (3)   The burn shall commence no earlier than one hour after sunrise and be extinguished one hour before sunset.
      (4)   The burn shall be a single burn pile in no larger than 60 inches in diameter and 36 inches in height at any time.
      (5)   The burn shall be attended by a responsible person at all times.
      (6)   Water must be available at the burn area at all times.
      (7)   The burn shall not cause adverse health effects to humans. Persons claiming such adverse health effects will verbally notify the police department or the fire department of the same. The police department or the fire marshal shall then direct that the open fire be immediately and completely extinguished. Failure to comply will subject the person with the open fire to the penalty provisions.
      (8)   The burn shall be extinguished when so ordered by a fire, police, or environmental quality official.
      (9)   A burn shall not be commenced when wind or any other conditions create an unsafe environment.
      (10)   Burning in drainage ditches is expressly prohibited.
      (11)   A burn shall not be allowed anytime the County Judge/City Mayor issues a burn ban for the county/city.
   (C)   Prohibited. The following list of items, while not exhaustive, shall not be burned: household solid waste, tires, petroleum products, putrescible waste, hazardous waste, construction or demolition waste, garbage or municipal solid waste, treated wood, furniture, carpet, electrical wire, appliances, diseased animal carcasses or any other item thought by the federal state or local government to be a public nuisance or hazard.
