§ 10-1-13 MINORS.
   A.   It is unlawful for any person under the age of 16 years to idle or loiter upon the streets or public places of the city between the hours of 9:00 p.m. and 6:00 a.m. from October 1 to May 1 and between the hours of 10:00 p.m. and 6:00 a.m. from May 1 to October 1, unless the person is accompanied by a parent, guardian, or some person of lawful age having legal custody of the person. It is unlawful for any parent, guardian, or other adult person having the care and custody of the person to encourage or allow the person to idle or loiter upon the streets or public places between the hours of 9:00 p.m. and 6:00 a.m. from October 1 to May 1 and between the hours of 10:00 p.m. and 6:00 a.m. from May 1 to October 1, unless accompanied by the parent or guardian. The provisions of this section shall not apply when the person is upon an emergency errand or legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of the person.
   B.   It shall be unlawful for any person the age of 16 or 17 to loiter or idle upon the streets or public places of the city between the hours of 11:00 p.m. and 6:00 a.m. from January 1 to December 31. It shall be unlawful for any parent, guardian, or other adult person having the care and custody of the person to encourage or allow the person to idle or loiter upon the public streets or public places between the hours of 11:00 p.m. and 6:00 a.m. from January 1 to December 31, unless the person is accompanied by a parent, guardian, or some person of lawful age having legal custody of the person.
   C.   Any minor who shall violate the provisions of this section for the first offense shall be warned by the Police Chief or a police officer and sent home. On the second offense, proceedings may be taken according to state statute.
