§ 9-2-5 SPECIAL REFUSE AND HAZARDOUS WASTE; PROHIBITED SUBSTANCES; METHOD OF COLLECTION; EXCEPTION.
   A.   Generally. No person shall deposit, or cause to be deposited, in any refuse container which is serviced by the city any prohibited substance, as defined in § 9-1-1. All prohibited substances shall be separated from containers used for regular collections and placed in special containers, and the contents therefor shall be clearly labeled.
   B.   Special collection. Every refuse generator having these types of items for collection shall call the Public Works office for special collection. This section shall not apply to any refuse generator who has secured the written approval of the city for otherwise disposing of prohibited substances.
   C.   Hazardous and dangerous waste.
      1.   Generally. Hazardous wastes shall be placed in a proper container and plainly and properly marked. The Public Works Director shall be notified and shall instruct the customer as to the proper disposition of the waste in accordance with transfer station and/or landfill instructions.
      2.   Right to deny service. The city reserves the right to deny refuse collection service for refuse which the Public Works Director determines to be hazardous and to require the customer to properly dispose of it by other means. No person shall deposit, or cause to be deposited, in any refuse container which is serviced by the city anything which will be dangerous or hazardous to the city's collection equipment or a threat to the health, safety, and welfare of the city employees or general public.
      3.   Landfill.
         a.   As the city utilizes the transfer station and/or landfill, we must additionally abide by their rules and regulations, particularly when it involves hazardous and dangerous waste.
         b.   The Public Works Director is required to work closely with the transfer station and/or landfill personnel in regards to this specific matter.
      4.   Explosives and inflammable materials. Explosives such as arms ammunition, war souvenirs, or explosive items or powder of any kind, and highly inflammable materials, shall not be placed in any refuse container. Residents shall dispose of these items by calling the City Public Works Department for special instructions or pickup.
      5.   Acids, caustics, and rapid oxidizers. Acids, caustics, and rapid oxidizers, including chemicals used in swimming pools, shall not be disposed of in refuse containers. Residents shall dispose of these chemicals by calling the City Public Works Department for containment instructions and/or special pickup.
      6.   Coals and ashes. Warm or hot coals or ashes shall not be placed in any refuse container.
   D.   Dead animals.
      1.   Small dead animals may be placed in plastic bags, tied and placed in the regular refuse container, or should be properly disposed of by the owner by other means. Livestock shall be disposed of by the owner.
      2.   Small dead animals in the public right-of-way will be removed and disposed of by the County Humane Society. Persons shall call the City Police Department and report the location and the dispatcher will handle arrangements thereafter.
      3.   Condemned animals and parts of animals from slaughterhouses or similar places regardless of size will not be collected by the city.
   E.   Byproducts. Any commercial or manufacturing establishment (including fruit and vegetable packing houses or manufacturing or processing plants) which by the nature of its operations create an unusual amount of byproduct refuse, may be required by the city to dispose of its own waste as opposed to having the city provide the service. This would generally be handled by mutual agreement between the city and establishment at time of startup operations.
   F.   Soil and concrete waste. All owners, contractors, and builders of structures shall, upon the completion of any such structure, remove, at their sole cost and expense, all refuse of every nature, description, or kind which has resulted from building of the structure, including lumber scraps, shingles, plaster, brick, stone, concrete, and other building material, and shall place the lot, and all nearby premises utilized in the construction, in a clean and sightly condition.
   G.   Debris. Debris resulting from the construction, reconstruction, demolition, or repair of premises shall not be placed with other refuse for collection, but shall be disposed of directly by the contractor or by the person owning, occupying, or leasing the premise wherein the debris is accumulated. All the wastes shall be removed promptly and shall not be stored in any location where it may be blown or otherwise dispersed beyond the construction site.
   H.   Landscape contractor's waste. The city will not dispose of waste generated by persons hired for the purpose of landscape work. This refuse shall be disposed of directly by the contractor or by the person owning, occupying, or leasing the premises. All the wastes shall be removed promptly and shall not be stored where it will blow or otherwise disperse beyond the premises. Arrangements can be made with the city for a special pickup.
