§ 1426.04 GRADE AT THE BUILDING SITE.
   The City Engineer shall establish the grade for any proposed building. The finished grade at the building shall not be less than a 2% gradient above the crown of the road, as measured from the edge of the dedicated portion of the road, except that in any particular case where the applicant can show that, by reason of exceptional topographical or other physical conditions, the establishment of a 2% gradient would cause practical difficulties or undue hardship, the City Engineer may allow the establishment of a different grade which is just and proper, so as to relieve such difficulty or hardship. Before proceeding beyond the foundation for such building, the applicant shall request further inspection by the City Engineer, who shall determine whether such foundation has been constructed in accordance with the established grade. At the direction of the City Engineer, the Chief Building Official shall not permit the continuance of construction beyond the foundation for any building if he or she finds that the foundation has not been constructed in accordance with the established grade.
