(a) Retail, commercial and industrial certificates. The owner or his or her agent having charge of the construction of any retail, commercial or industrial building is prohibited from allowing or permitting such structure to be occupied, or to have furnishings installed or stored therein, until it has been finally inspected and approved by the Engineering Department, the Chief Building Official and, at his or her request, the Fire Chief. In addition to the foregoing requirements, a change in ownership and/or building tenancy of a nonresidential building shall require the issuance of a certificate of occupancy. Such certificate shall not be issued until the Building Department, and if required, the Fire Department has inspected and approved the building in accordance with the relevant codified ordinances of the city, and not until the Planning Director or his or her designee has approved the use in accordance with the provisions of the City Zoning Code.
(b) Residential certificates. The owner or his or her agent having charge of the construction of any residential dwelling, including a dwelling moved within or into the city pursuant to a permit issued under Chapter 1468, is prohibited from allowing or permitting such structure to be occupied or to have furnishings installed or stored therein until it has been finally inspected by the Engineering Department, the Chief Building Official and, at his or her request, the Fire Chief. When the Engineering Department finds that the final grades, sewers, water lines and drains have been installed in accordance with the permits issued therefor, and when the Chief Building Official and Fire Chief find that the structure has been completed in accordance with the permits issued therefor and all laws and ordinances applicable thereto, the Chief Building Official shall, upon application, issue a certificate of occupancy to the person applying therefor. When the Engineering Department, Chief Building Official and Fire Chief find that the structure has been substantially completed so as to permit the safe and healthful occupation of the structure, the Chief Building Official shall, upon application, issue a temporary certificate of occupancy which shall list the incomplete items to be completed, within 30 days of issuance, weather permitting, with regard to exterior punch list items.
