(a) No owner or occupant of property or other person, corporation, partnership, association or other entity or any agent, independent contractor, servant, lessee or tenant thereof (hereinafter referred to as the “applicant”) shall connect or cause to be connected any structure or accessory structure to the water line in the Gemma Subdivision or service any parcel situated in the restricted service area from the water line in the Gemma Subdivision, as established in Exhibit “A” attached to original Ordinance 1995-204, passed November 6, 1995, being Permanent Parcel Nos. 952-037-008, 952-037-014, 952-037-019, 952-038-009, 952-038-011 and 952-038-013, unless the applicant shall have first paid a connection fee for such purpose to the city.
(b) The connection fee described in division (a) hereof shall be $3,100.
(c) The proceeds from the permit set forth in division (b) hereof shall be used to reimburse Dr. Charles Gemma and Carlette Gemma, 5274 SOM Center Road, Solon, Ohio, for their costs for construction of a water line as a result of the Gemma lot split.
(d) The fee required in division (a) hereof shall only be required of any potential applicant until December 31, 2015. After December 31, 2015, no permit shall be required and this connection fee requirement shall be null and void.
(e) The Clerk of Council is hereby authorized and directed to deliver a certified copy of this section, together with the required filing fee, to the Auditor of Cuyahoga County for recording pursuant to R.C. § 319.61.
