§ 1044.28 CONFIDENTIAL INFORMATION.
   (a)   All information and data acquired by any means authorized in this chapter shall be available to the public or any other governmental agency without restriction except as hereinafter provided for.
   (b)   Information and data may be deemed confidential by the Approving Authority upon written request by any person for confidentiality, provided, however, that the person is able to demonstrate to the satisfaction of the Approving Authority that the release or publication of such information would divulge information, methods, processes or other trade secrets which may jeopardize the applicants competitive position.
   (c)   Information, data or material deemed confidential shall not be available for public inspection but shall be available to any governmental agency for studies and/or judicial review, provided that such confidential information shall not be provided to anyone until and unless adequate notification is given to the applicant.
   (d)   All records containing confidential material shall be stored in locked files.
   (e)   Wastewater characteristics and constituents will not be considered as confidential information.
