§ 1044.26 INSPECTION AND SAMPLING.
   (a)   The Authority shall randomly sample and analyze the effluent from industrial users and conduct surveillance activities in order to identify, independently of information supplied by industrial users, occasional and continuing noncompliance with pretreatment standards. The Authority shall inspect and sample the effluent from each significant industrial user at least once a year and evaluate, at least once every control mechanism cycle, whether each such significant industrial user needs a plan to control slug discharges. For purposes of this division (a), a SLUG DISCHARGE is any discharge of a non-routine, episodic nature, including, but not limited to, an accidental spill or a non-customary batch discharge. If the Authority decides that a slug control plan is needed, the plan shall contain the following elements:
      (1)   A description of discharge practices, including non-routine batch discharges;
      (2)   A description of stored chemicals;
      (3)   A procedure for immediately notifying the Authority of slug discharges, including any discharge that would violate a prohibition under § 1044.05 of this chapter, with procedures for follow-up written notification within five days; and
      (4)   If necessary, procedures to prevent adverse impact from accidental spills, including inspection and maintenance of storage areas, handling and transfer of materials, loading and unloading operations, control of plant site run-off, worker training, building of containment structures or equipment, measures for containing toxic organic pollutants (including solvents) and/or measures and equipment for emergency response.
   (b)   The Authority may, for any purpose, including those listed in division (a) hereof, inspect the facilities of any industrial user to determine compliance with the requirements of this Code. The industrial user shall allow the Authority or its representatives, upon presentation of credentials of identification, to enter upon the premises of the industrial user at all reasonable hours, for the purposes of inspection, sampling or records examination and copying. The Authority shall have the right to set up on the industrial user’s property such devices as are necessary to conduct sampling, inspection, compliance monitoring and/or metering operations.
