(a) Service generally. Each provider shall extend their service and make service available to the dwelling units and places of business in the city within the time periods and in the manner set forth in each provider’s respective franchise agreement or competitive video service agreement.
(b) Service to schools and public buildings. It is the city’s intention that each accredited primary and secondary school building, each city government building, and each public library building within the city be provided with cable service, IP video service or similar service at no cost, and that the burden of providing such connections be shared by all cable and IP video service providers in the city in an equitable manner. The providers will offer one free installation and free monthly IP video service to one outlet at each public school, city government building, fire station, police station and library building that is passed by the provider’s system. The provider shall have the responsibility to offer a free installation and free monthly IP video service to a share of such schools, governmental or library buildings. The provider’s share shall be proportionate to the total number of cable operators or competitive video service providers unless other negotiated compensation has been provided to the city. The providers will supply the city with a list showing the responsibility of who will provide and maintain video or cable service to which school or public building, within 30 days of the providers’ negotiation for such service.
(c) Negotiation. The video service provider shall negotiate with other providers in good faith, as necessary, to determine who will provide video service to which school or public building, and the Mayor shall have the right to participate in such negotiations. If providers are unable to reach agreement as to who will provide free video service to which school, governmental or library building, the Mayor, or his or her designee, will confer with the providers and determine the assignments in a reasonable manner. This obligation will apply to a new provider of video service once that provider’s video service is available on the section of its system that passes the school or public building assigned to that provider. Until such time, the incumbent provider of video service to that location will provide video service to such school or public building.
