§ 5-4-2 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ABANDONED VEHICLE. A vehicle shall be deemed to be ABANDONED under any of the following circumstances; provided, however, that a vehicle left unattended due to adverse road or weather conditions, acts of God, or mechanical difficulties shall not be deemed to be ABANDONED for the period required to see the passage of the conditions or a reasonable time to remove the vehicle for repairs:
      (1)   If the vehicle is left unattended on a highway, public street, or alley within the jurisdictional limits of the town for more than 24 hours after a notice of intent to impound has been placed on the vehicle by a police officer pursuant to this title;
      (2)   Any vehicle left unattended on public or private property without the oral or written consent of the owner or person in lawful possession or control of the property for more than five days after a notice of intent to impound has been placed on the vehicle by a police officer pursuant to this title; and/or
      (3)   Any vehicle left unattended or unclaimed on private property for more than 30 days without the oral or written consent of the owner or the person in lawful possession or control of the property or for more than 30 days without the oral or written consent of the owner or the person in lawful possession or control of the property after the expiration of the oral or written consent.
      (4)   For the purposes of this chapter, a junk vehicle shall be presumed to be abandoned if the owner has been afforded the notice and procedure requirements of this chapter and the vehicle remains in noncompliance.
   JUNK VEHICLE. A vehicle, or parts thereof, shall be deemed to be JUNK under any of the following circumstances:
      (1)   Any vehicle wrecked, damaged, or disabled to the extent that it is unable to perform its original intended function;
      (2)   Any vehicle partially or wholly dismantled;
      (3)   Any vehicle wrecked or damaged to the extent that prevents legal operation; and/or
      (4)   Any vehicle junked or intended to be recycled or scrapped.
