The Clerk-Treasurer, Chief of Police, and Service Director are recognized as exempt employees for overtime purposes under the Fair Labor Standard Act. Other than for overtime purposes and unless a provision of Chapter 139 clearly applies to wage-earning employees only, the Clerk-Treasurer, Chief of Police, and Service Director shall be regular, full-time employees for purposes of Chapter 139. Provided, further, that such positions shall have the benefits, where applicable, as determined herein, as a minimum. From and after the date of this enactment, for any such position, additional benefits granted shall be granted by specific ordinance.
