§ 91.02 APPLICATION AND BOND.
   (A)   In the application for a permit the person shall state the place where, the time when, and the reason for such street opening and excavation, and the probable time when the street will be replaced in good condition. With the application, the person shall post with the City Clerk a good and sufficient bond in the sum specified below conditioned upon the faithful performance of his or her duty to replace such surface material and excavation, and place the street, alley, or public way in as good condition as it was immediately prior to such opening, ordinary wear and reasonable allowance being made for such repairs.
   (B)   The City Clerk shall receive such application and, if reasonable grounds are presented for such street opening, he or she shall accept such bond and issue a permit to the applicant to remove the surface material and make such excavation as is necessary. If the permit is refused, the tendered bond shall not be accepted.
   (C)   In the case of utilities, which are making excavations and removing street surfaces periodically and from time to time, a permanent bond may be posted and filed with the City Clerk as stated in division (D) below, rather than posting bond in each individual case, if the utility so desires.
   (D)   The bond to be posted by each applicant for permission to open a street and remove a portion of the surface material thereof shall be as follows.
      (1)   Where the hole in the street will not exceed ten square feet in surface area, the fee shall be $100.
      (2)   Where the hole in the street will not exceed 25 square feet in surface area, the fee shall be $150.
      (3)   Where the hole in the street exceeds 25 square feet in surface area, the fee shall be $250.
      (4)   The permanent bond to be posted by utilities and contractors shall be in the amount of $300.
   (E)   All fees collected hereunder shall be paid into the General Fund of the city.
