§ 94.99 PENALTY.

(A) Any person violating any provision of § 94.02 shall be guilty of a Class 3 misdemeanor. ('76 Code, § 10-1-12) (Ord. 651, passed 9-22-83; Am. Ord. 890, passed 10-10-91; Am. Ord. 2004-006, passed 5-13-04; Am. Ord. 2014-001, passed 1-9-14)

(B) Any person who violates the prohibitions of § 94.03, where hours of operation notices are posted, shall be guilty of a petty offense. ('76 Code, § 10-1-11) (Ord. 522, passed 11-13-80; Am. Ord. 851, passed 12-14-89; Am. Ord. 2004-006, passed 5-13-04; Am. Ord. 2014-001, passed 1-9-14)

(D) (1) With the exception of §§ 94.02, 94.03, and 94.07 any person violating any provision of this chapter shall be guilty of a Class 3 misdemeanor.

(2) Repeated offenses may incur additional penalties of imprisonment, and/or both a fine and imprisonment as determined by the court.
