1313.064   APPEAL TO THE CITIZENS PEER REVIEW COMMITTEE/CPRC.
   (a)   Notice of Appeal. An appeal shall be filed within thirty days after receipt of the written notice of the City Manager or his or her designee. The appellate shall pay a fifteen dollar ($15.00) filing fee and file a written notice of appeal with the CPRC through the Code Enforcement Office. The filing of an appeal suspends any further enforcement action on said matter, until an official decision by the CPRC has been rendered.
   (b)   Hearing on Appeal. The CPRC shall select a date, time and place for the hearing of an appeal. Within thirty days of the filing of the appeal, the CPRC shall notify the appealing party, in writing, of such selected date, time and place. The date of the hearing shall be no more than forty-five days from the date the appeal was filed.
   (c)   Decision on Appeal. The CPRC shall have all powers of the City Manager or his or her designee with respect to such decision. The concurring vote of at least five members in attendance at the hearing shall be necessary to reverse or modify any decision of the City Manager or his or her designee under the painting ordinance (Section 1313.063). The CPRC shall render a written decision containing relevant findings of fact without unreasonable delay after the close of the hearing, and in all cases within fifteen days after the close of the hearing.
      (1)   In cases where the CPRC concurs with the original notice of violation and repair order issued by the City Manager or his or her designee, the original notice of violation and repair order shall constitute the written decision of the committee.
      (2)   In cases where the CPRC’s decision differs from the original notice of violation and repair order issued by the City Manager or his or her designee, the CPRC majority shall collectively draft, approve and formally submit written findings based on their decision to the City Manager or his or her designee, who will then mail the decision to the appealing property owner.
