925.035 FISHING IN CITY PARKS AFTER HOURS.
   (a)   No person over the age of sixteen years shall be allowed in any City park after the posted hours set forth in Section 925.09 for the purpose of fishing, unless such person holds a valid City fishing permit and such person is exclusively engaging in fishing activities.
   (b)   No person under the age of sixteen years shall be allowed in any City park after the posted hours set forth in Section 925.09 unless such person is accompanied by a person who holds a valid City fishing permit, provided that the person under the age of sixteen years is also exclusively engaging in fishing activities.
   (c)   Fishing after hours shall be permitted with a fishing permit in the following City parks: Old Water Works Park, Custenborder Field, Tawawa Park, Flanagan Sports Complex, Roadside Park, Johnson Drive Park, Veteran's Memorial Walkway and Berger Park.
   (d)   To be eligible to receive a fishing permit, all applicants must be at least sixteen years of age or older and possess a valid State of Ohio Department of Natural Resources fishing license. In addition, each applicant shall file an application with the Parks and Recreation Department providing the following information:
      (1)   The applicant's name.
      (2)   The applicant's residence address.
      (3)   The applicant's home phone number
      (4)   The applicant's height, weight, eye color and hair color.
      (5)   The applicant's Social Security number.
      (6)   The applicant's driver's license number (if applicable).
      (7)   A photocopy of the applicant's State of Ohio fishing license.
      (8)   A photocopy of a form of identification, e.g. a driver's license, Social Security card, birth certificate, etc.
      (9)   The make, model and license plate number of any vehicle likely to be driven by the permit holder and parked in City parks while engaging in after-hours fishing activities.
   Applications shall be available at the Parks and Recreation office during regular business hours, Monday through Friday, and at the Police Department outside of regular City office hours.
   (e)   The Parks and Recreation Director, or in his absence, a Park Ranger, shall issue fishing permits.
   (f)   All persons issued a fishing permit must wear their permit cards on their outer clothing, clearly in view, while engaging in fishing activities in City parks after hours.
   (g)   Persons holding fishing permits who park their vehicles in City parks after hours for the purpose of fishing shall place a placard, provided by the City, in their front windshield area for observation by City law enforcement officers.
   (h)   Fishing permit holders who wish to park in City parks after hours must use areas designated by the Parks and Recreation Director.
   (i)   The right to park vehicles in City parks after hours shall apply only to the vehicle noted by the applicant in the application. Vehicles not identified by the applicant will not be allowed to be parked in the City parks after posted hours. The permit holder may amend the recognized vehicles on his application at any time by filing an appropriate form with the Parks and Recreation Director.
   (j)   Vehicles not displaying the appropriate placard, not parked in designated areas or not registered with the Parks and Recreation Department, will be subject to towing and citation for being in violation of this section.
   (k)   Any person denied a fishing permit may file an appeal of that decision with the City Manager. The City Manager shall conduct a hearing with the party denied the permit and issue a decision within thirty calendar days of the receipt of this appeal. The decision of the City Manager shall be final.
