904.04   APPLICATION.
   (a)   A person seeking a parade, public assembly or special event permit shall file an application with the City Manager on forms provided by the Manager. The application shall be signed by the applicant.
   (b)   For parades, public assemblies or special events, an application for a permit shall be filed with the City Manager at least 30 days prior to the parade, public assembly or special event is proposed to commence. The City Manager may waive the minimum filing period and accept an application filed within a shorter period if, after due consideration of the date, time, place, and nature of the parade, public assembly or special event, the anticipated number of participants, and the City services required in connection with the event, such that the City Manager determines that the waiver will not present a hazard to public safety.
   (c)   The application for a parade, public assembly or special event shall set forth the following information:
      (1)   The name, address and telephone number of the person seeking to conduct such parade, public assembly or special event;
      (2)   The names, addresses and telephone numbers of the organization for which the parade, public assembly or special event is to be conducted, if any, and the authorized and responsible heads of the organization;
      (3)   The requested date of the parade, public assembly or special event;
      (4)   The route to be traveled, including the starting point and the termination point;
      (5)   The approximate number of persons who, and animals and vehicles which will constitute such parade, public assembly or special event and the type of animals and description of the vehicles;
      (6)   The hours when such parade, public assembly or special event will start and terminate;
      (7)   A statement as to whether the parade, public assembly or special event will occupy all or only a portion of the width of the streets proposed to be traversed;
      (8)   The location by street of any assembly areas for such parade, public assembly or special event;
      (9)   The time at which units of the parade, public assembly or special event will begin to assembly at any such area;
      (10)   The intervals of space to be maintained between units of such parade, public assembly or special event;
      (11)   If the parade, public assembly or special event is designed to be held by, or on behalf of, any person other than the applicant, the applicant for such permit shall file a letter from that person with the City Manager authorizing the applicant to apply for the permit on his behalf;
      (12)   The type of parade, public assembly or special event, including a description of activities planned during the event;
      (13)   A description of any recording equipment, sound amplification equipment, banners, signs, or other attention-getting devices to be used in connection with the parade, public assembly or special event;
      (14)   The approximate number of participants (spectators are by definition not participants);
      (15)   The approximate number of spectators;
      (16)   A designation of any public facilities or equipment to be utilized; and
      (17)   Any additional information that the City Manager finds reasonably necessary to a fair determination as to whether a permit should be issued.
      (18)   Insurance must be maintained at all times during the parade, public assembly or special event, which such insurance shall insure against claims to persons or damages to property which may arise in connection with the Use: Commercial General Liability Insurance on an occurrence basis, with coverage at least as broad as ISO Form CG 00 01 12 07, including products-completed operations, and personal and advertising injury, with limits of not less than one million ($1,000,000.00) dollars per occurrence. The subject Certificate shall include the following language: The following are additional insureds: The City of Sidney, its elected and appointed officials, all employees and volunteers, all boards, commissions and/or authorities and board members, including employees and volunteers thereof. Coverage shall be primary to the additional insureds and not contributing with any other insurance or similar protection available to the additional insured whether other available coverage be primary, contributing or excess.
      (19)   Electrical connections along the Courthouse Square shall be made in accordance with the current adopted version of the National Electric Code Article on Carnivals, Circuses, Fairs and Similar Events. Event applications shall indicate the need for electrical connections.
      (20)   Activities being held on public grounds (City parks, municipal pools, etc.) or residential neighborhood block parties may not be required to provide a Certificate of Insurance except those events which include food vendors, alcohol, or the erection of tents and other structures on City property, or events for which the host group charges fees. The necessity of a Certificate of Insurance for other events will require a case-by-case assessment of the risk by the City Manager or designee.
