351.173 HANDICAPPED PARKING SPACES IN RESIDENTIAL AREAS.
   (a)   The City Manager, at his or her discretion and upon application, may designate handicapped parking spaces in residential areas, the exact location of which shall be determined by the City Manager.
   (b)   Before designating a handicapped parking space in a residential area, the City Manager must determine that:
      (1)   The applicant is a person with a disability that limits or impairs the ability to walk as defined in Ohio R.C. 4503.44(A)(2).
      (2)   The applicant possesses either handicapped license plates or a permanent parking card as issued by the Registrar of Motor Vehicles.
      (3)   It is not practical for the handicapped person to use an existing driveway or a pull-off area from an alley.
      (4)   The construction of a driveway would have a negative impact on the surrounding areas or is otherwise not practical due to terrain or vegetation.
   (c)   The handicapped space designation shall be made on an annual basis and must be requested on the forms supplied by the City Manager's office.
   (d)   Handicapped spaces in residential areas are available to any person with a handicapped parking card or license plate issued under Ohio R.C. 4503.44 and are not reserved for any one individual.
   (e)   The City Manager shall cause all residential parking spaces for the handicapped to be designated by the appropriate sign.
   (f)   Section 351.04(e) shall apply to the handicapped parking spaces designated under this section.
