The agreement with nonresident applicants may provide for a fixed term or indefinite term; provided that such agreement shall require that such nonresident water and sewer connections must be removed either temporarily or permanently at any time city water or sewer lines become, or may become overtaxed, it being the intent of the city to adequately serve all residents of the city either presently connected or that may hereafter connect to water and sewer lines, and to allow connections by nonresidents only when there is excess capacity in such lines available.
