§ 31.41 ASSISTANT POLICE CHIEF.
   (A)   The office of Assistant Chief of Police is hereby created.
   (B)   The Assistant Chief of Police shall be appointed by the Mayor with the approval of the City Council to serve at the pleasure of the Mayor.
   (C)   An appointee to the office of Assistant Chief of Police shall retain his civil service rank and may obtain advancements in civil service rank while holding office as Assistant Chief of Police.
   (D)   Notwithstanding his civil service rank, the Assistant Chief of Police shall have, in the absence of the Police Chief, the command authority, powers and duties of the Chief of Police as set out in the command structure illustrated in § 35.09.
