§ 97.01 PERMIT REQUIRED.
   Any person, firm, corporation or other entity conducting a yard sale shall obtain a yard sale permit from the City Clerk/Tax Assessor before conducting the sale. A yard sale permit shall be in lieu of a business license required by Chapters 111 and 112 of this code.

§ 97.02 PERMIT; FEE.
   The cost of a yard sale permit shall be ten ($10.00) dollars. The issuance of the permit shall constitute an unassignable authorization for the holder to conduct one (1) sale during the calendar year in which the permit is issued. No more than two (2) permits may be issued to any applicant during the calendar year. The yard sale for which a permit is issued shall be limited in duration to two (2) days. At the time of issuance of the permit, the date or dates of the sale shall be specified on the permit by the City Clerk/Tax Assessor who shall furnish a copy of the permit to the police department. The City Clerk/Tax Assessor shall maintain in the Clerk's office a register of permits issued.

§ 97.99 PENALTY.
   (A)   Failure to obtain a yard sale permit prior to conducting a yard sale or conducting a yard sale on a date other than specified in the permit shall constitute a violation of this chapter.
   (B)   Violation of this chapter shall constitute a criminal violation for which a citation may issue returnable to District Court with a fine to be assessed for each violation consistent with subsection (C) of this section, or at the option of the city, and in addition to the foregoing, a violation shall constitute a civil offense and shall be enforced pursuant to the provisions of Chapter 41.
   (C)   Any person, firm, corporation or other entity found guilty of violating this chapter shall be guilty of a misdemeanor and shall be fined not less than twenty-five ($25.00) dollars, nor more than two hundred ($200.00) dollars, or imprisoned in the county jail for not more than thirty (30) days or both.
   (D)   The civil penalty for violating this chapter shall be not less than one hundred dollars ($100.00) nor more than one thousand dollars ($1,000.00). Each day's violation shall constitute a separate offense. This chapter shall be subject to enforcement by the Code Enforcement Board of the city.
