§ 35.38 QUALIFICATIONS OF APPLICANTS.
   The Civil Service Commission shall examine all applicants as to their physical and mental qualification for the particular classification wherein they seek employment. To be eligible for examination, a person must not be less than 18 nor have passed his forty-sixth birthday, be a law-abiding citizen of sobriety and integrity, and must be able to read, write, and understand the English language; provided, however, that any present Police or Fire Department member is over 45 years of age and who is otherwise qualified shall be eligible to take any promotional examinations.
