If any enforcement officer finds that a Class A nuisance is being caused or permitted and should be abated, the enforcement officer shall determine and confront the person responsible for the nuisance and order that person to forthwith abate or case and desist from any act causing or constituting the nuisance. Any person failing to comply with an order of the enforcement officer shall be subject to immediate citation for a penal violation, and subject to the penalties as provided by § 92.99
