§ 33.08 COMMISSION OPERATIONS.
   (A)   (1)   The Mayor, subject to the approval of the City Council, shall appoint five persons who shall constitute the Civil Service Commission of the city.
      (2)   The qualifications of the members shall be as follows.
         (a)   Each member shall be at least 30 years of age.
         (b)   No member shall be related by blood or marriage to the Mayor or any member of the City Council.
         (c)   Each member shall meet the qualifications as prescribed by KRS Ch. 90 or KRS Ch. 95, as those chapters of the Kentucky Revised Statutes relate to cities of the class of which the city is at any given time, including, but not limited to, the requirement that members shall have been taxpayers and voters of the city for not less than five years immediately preceding their appointment and shall continue their residence and status as voters within the city during their tenure as Commission members.
   (B)   The terms of service of the Commission members shall be for a period of three years with one appointment (the current Chairperson) currently set to expire on 7-23-2017. Another appointment currently set to expire on 1-12-2017 and a third appointment (the Vice-Chairperson) currently set to expire on 10-10-2018. The Commissioners currently serving shall continue to serve until their terms expire and their successor is appointed and sworn in. No Commissioner shall be removed other than for cause and then only with the approval of a majority of the members of the City Council. No more than two members of the Commission may be members of the same political party. (Registration as an independent shall not be construed as registering as a member of a political party.)
   (C)   If the Mayor fails to submit the name of a qualified potential appointee to the Commission when a vacancy occurs within 30 days, the City Council may, by majority vote, appoint a qualified individual to serve on the Civil Service Commission. In the appointment to fill a vacancy on the Commission, such individual shall hold office until the expiration of the term of the Commission member whose resignation or removal created the vacancy.
   (D)   The Civil Service Commissioners may receive a salary as fixed by the City Council.
   (E)   (1)   The Civil Service Commission shall make and enforce rules, not inconsistent with the provisions of KRS Ch. 90 and KRS Ch. 95 and the ordinances of the city, for the examination and hiring of employees for the city and the promotion of employees of the city and for the conduct of hearings. The Commission shall have the discretion to exercise its authority in hearings in a manner consistent with procedural due process and the principles of justice and fair dealing with all parties that may come before it. The Commission shall have authority to seek legal advice from and obtain counsel of its choosing, with the costs of same to be borne by the city.
      (2)   The Civil Service Commission shall have its counsel at any and all appeal hearings.
