§ 158.005 ADMINISTRATION AND ENFORCEMENT.
   (A)   General. The city shall administer and enforce this chapter.
   (B)   Appointment of the Code Official. The Code Official shall be appointed by the Mayor.
   (C)   Deputies. Only the Mayor has authority to appoint deputy code officials.
   (D)   Liability. The Code Official, member of the Code Enforcement Board, or employee charged with the enforcement of this chapter, while acting for the city, in good faith and without malice in the discharge of the duties required by this chapter or other pertinent law or ordinance, shall not thereby be rendered personally liable, and is hereby relieved from all personal liability for any damage accruing to persons or property as a result of an act or omission or by reason of an act or omission in the discharge of official duties. Any suit instituted against the Code Official, member of the Code Enforcement Board, or employee because of an act performed by that Code Official, member of the Code Enforcement Board, or employee in the lawful discharge of duties and under the provisions of this chapter, shall be defended by the legal representative of the city until the final termination of the proceedings. The Code Official, member of the Code Enforcement Board, employee, or any subordinate thereof, shall not be liable for costs in an action, suit, or proceeding instituted in pursuance of the provisions of this chapter.
   (E)   Fees. The fees for activities and services performed by the city in carrying out its responsibilities under this chapter shall be as established by separate ordinance by the City Council.
