(A) Office created. There is hereby created the office of Fire Chief.
(B) Duties and powers. The duties and powers of the Fire Chief shall be as set forth in the Personnel and Pay Rate Classification Plan, Ordinance No. 019-283, passed on February 11 2019, which is incorporated herein by reference and made a part hereof. Any future amendments to Ordinance No. 019-283 shall, to the extent such amendments change the duties and powers of the office of Fire Chief, constitute amendments to this section.
(C) Qualifications. The qualifications of the Fire Chief shall be as set forth in Ordinance No. 019-283.
(D) Tenure. Pursuant to KRS 83A.080(3), the Fire Chief shall be appointed by the Mayor with the approval of City Council. Pursuant to KRS 83A.080(3), the Mayor, with the approval of City Council, may remove the Fire Chief at will, except as otherwise provided by statute or ordinance.
(E) Oath.
(1) No individual shall enter upon the discharge of the duties of the office of Fire Chief, without first having taken the following oath as set forth in § 228 of the Kentucky Constitution: “I do solemnly swear (or affirm, as the case may be) that I will support the Constitution of this Commonwealth, and of the Constitution of the United States, and be faithful and true to the Commonwealth of Kentucky, so long as I continue a citizen thereof, and that I will faithfully execute, to the best of my ability, the office of Fire Chief, according to law; and I do further solemnly swear (or affirm) that, since the adoption of the present Constitution, I being a citizen of this United States, have not fought a duel with deadly weapons within this State, nor out of it, nor have I sent or accepted a challenge to fight a duel with deadly weapons, nor have I acted as a second in carrying a challenge, nor aided or assisted any person thus offending, so help me God.”
(2) The person administering the oath of office shall certify, in writing, that the oath of office was administered, and the date of its administration. The written certification shall be filed in accordance with the mandates of KRS Ch. 62, if required by same.
(F) Compensation. The rate of compensation for the Fire Chief shall be fixed by the Mayor as set forth in Ordinance No. 019-283.
(G) Bond. No bond shall be required.
