(A) (1) This chapter is adopted pursuant to the powers granted and limitations imposed by state laws, including the statutory authority granted to state municipal corporations pursuant to the Kentucky Revised Statues.
(2) This chapter is adopted pursuant to requirements of the national pollutant discharge elimination system and the state’s pollutant discharge elimination system storm water phase II.
(B) (1) This chapter shall be known as the “Storm Water Quality Management Ordinance” for the city, and may be so cited.
(2) The purpose of this chapter is to provide regulations and measures that will address storm water quality in the city and to establish procedures by which these requirements are to be administered and enforced.
(C) (1) The laws of the commonwealth shall apply to this chapter.
(2) This chapter shall govern all properties within the jurisdictional boundaries of the city.
(3) This chapter is applicable to all new development and redevelopment activities that result in the disturbance of one or mores acres of land including disturbance of less than one acre as part of a larger common plan.
(D) The following activities are exempt from the provisions of this chapter:
(1) Agricultural and silviculture (woodland production) operations according to an agricultural water quality plan approved by the city’s Conservation District or approved as required in the state’s Agricultural Water Quality Plan developed in accordance with the state’s Agricultural Water Quality Authority; and
(2) Land reclamation projects regulated by the state’s Department for surface mining reclamation and enforcement.
