Prior to the issuance of any permit pursuant to a plan that includes any storm water facilities, the applicant/owner shall execute a maintenance easement agreement that shall be binding on all subsequent owners of land served by the storm water facilities. The agreement shall provide for access to the facilities at any time for inspection by the approving agency, and for regular or special assessments of property owners to ensure the facilities are maintained in proper working conditions to meet design standards and any other provisions of this chapter. The easement agreement shall be filed with the approving agency and recorded in the office of the county’s Clerk.
