All storm water facilities shall be covered by an enforceable operation and maintenance agreement to ensure the system functions as designed. This agreement shall include any and all maintenance easements required to access and inspect the storm water facilities and to allow for routine maintenance as necessary to ensure proper functioning of the facilities. In addition, a legally binding and enforceable covenant specifying the party(ies) responsible for the proper maintenance of all storm water facilities subject to the agreement shall be secured prior to issuance of any permits for land-disturbance activities.
