§ 151.05 DRAINAGE COMPLIANCE.
   (A)   (1)   In addition to any and all building and sewer tap permits required by ordinance of the city, every individual, corporation, partnership or any other form of business entity seeking to construct or erect a building or addition to a building within the city limits shall be required to secure a drainage compliance permit.
      (2)   The cost of the drainage compliance permit shall be 1% of the total cost of the building or addition as certified by the builder and in accord with the plans; provided, however, the cost of the permit shall be not less than $200, nor more than $1,000.
      (3)   Upon completion of the building or addition, the permit holder shall notify the City Inspector who shall inspect the premises and construction to determine that adequate and proper drainage, including, but not limited to, culvert, driveway or street gutter cuts, and finish grade are such as to provide the correct and proper drainage of the property in such a manner as not to impede flow from other properties or to discharge surface water upon adjacent properties without adequate provision for runoff to suitable storm sewers or streams.
      (4)   Upon approval of the Building Inspector that the foregoing standards have been complied with, the building permit fee heretofore charged shall be refunded less the amount which shall be paid by the city to the Inspector for the inspection of same.
      (5)   In the event the permit holder does not seek the Building Inspector’s review within the allowable time set forth on the permit, the permit fee shall be forfeited.
      (6)   In the event the permit fee is forfeited, the city may use such funds to correct any drainage problems on or about the property and the holder of the permit specifically grants an easement to the city to do so.
   (B)   (1)   The Standard Specifications, Standard Drawings and Design Manual attached to the ordinance codified herein, as if set forth in full herein, are incorporated by reference.
         (a)   For the continued effectiveness of the design and construction standards and to promote the effectiveness of this division (B), the Mayor or the City Engineer, shall periodically review the Standard Specifications, Standard Drawings and Design Manual and propose necessary and reasonable changes, which, if approved by the City Council, shall be promptly made to the Standard Specifications, Standard Drawings and Design Manual. Any period changes to the Standard Specifications, Standard Drawings and Design Manual approved by the City Council shall be recorded in appendices to the Standard Specifications, Standard Drawings and Design Manual.
         (b)   A copy of said Standard Specifications, Standard Drawings and Design Manual and appendices (if any) are on file in the office of the City Clerk and the provisions of said Standard Specifications, Standard Drawings and Design Manual are hereby made a part of this division (B) as if copied herein in full, pursuant to the provisions of KRS 83A.060(5).
      (2)   All persons, firms, companies or corporations shall, before beginning any installation, alteration or change of any street, sanitary sewers and storm water drainage in the city shall obtain a construction permit for such work. Permits for installation and/or alteration shall be constructed in accordance with the criteria established in the adopted Standard Specifications, Standard Drawings and Design Manual.
